DMCA Notice & Takedown Policy

Last Updated: ((DATE))

((DOMAIN)) (the "Site") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), the Site will respond promptly to claims of copyright infringement that are reported to our designated copyright agent.

1. Reporting Copyright Infringement

If you believe that content available on or through this Site infringes one or more of your copyrights, please notify our copyright agent by submitting a written notice ("DMCA Takedown Notice") that includes all of the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has allegedly been infringed.
  2. Identification of the copyrighted work or works claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works is acceptable.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on the Site (such as the URL where the content appears).
  4. Information reasonably sufficient to permit us to contact you, such as your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please send your DMCA Takedown Notice to our designated copyright agent at:

2. Counter-Notification Procedure

If you believe that material you posted on the Site was removed or disabled by mistake or misidentification, you may file a counter-notification with our copyright agent. To be effective, a counter-notification must be a written communication that includes the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and inform them that we may replace the removed material or cease disabling it in 10 to 14 business days unless the copyright owner files an action seeking a court order against the alleged infringer.

3. Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. We reserve the right to remove content alleged to be infringing without prior notice and at our sole discretion.

4. Misrepresentation

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer, the copyright owner or its licensee, or the service provider.

5. Ownership of Site Content

All original content created and published on ((DOMAIN)) — including but not limited to text, graphics, and HTML code — is the intellectual property of the Site owner and is protected by applicable copyright law.
